At Sozialens, together with our partners listed on this page, we are committed to protecting your privacy. This Product Privacy Policy applies to your use of the Subscription Service (“Subscription Service”) as a Customer of Sozialens.

This Privacy Policy describes how we collect, receive, use, store, share, transfer and process your personal information. It also describes your options regarding its use, as well as your rights to access and correct your personal information.

This Privacy Policy applies to data that Sozialens processes on behalf of its customers (Customer Data) in our capacity as data processor. This Product Privacy Policy does not apply to any information or data collected by Sozialens as a controller for other purposes, such as information collected on our websites or through other channels for marketing purposes. Sozialens processes customer data at the direction of our Customers and has no direct control or ownership of the personal data we process. Customers are responsible for complying with any rules or laws that require notice and information to be provided and consent to be obtained before data is transferred to Sozialens for processing purposes. Terms not otherwise defined herein shall have the same meaning as set forth in the Sozialens Customer Terms and Conditions of Service (the “Agreement”). In the event of a conflict between this Product Privacy Policy and the Agreement, the terms of the Agreement shall prevail.

We periodically update this Product Privacy Policy. We will post any changes on this page and, if material, provide an updated notice by using the notifications application on your Sozialens Portal. We will notify you of any material changes to this Product Privacy Policy before they become effective, but we encourage you to review it periodically. We will also archive previous versions of this Product Privacy Policy so you can review them.

1. Using the Subscription Service

Sozialens Subscription Service Our subscription service allows users (typically small to medium-sized businesses) to search for influencers, gain insights into influencer audiences and effectiveness, create and manage influencer campaigns, and measure and analyze influencer posts. The Subscription Service may also be used to help organize influencer data about a business's marketing strategy (e.g., influencers, campaigns, posts, etc.). Information added to the Subscription Service, whether when influencers provide their contact information or when a user of the Service adds the information, is stored and managed on our service providers' servers. Sozialens provides the Subscription Service to our clients to meet their own marketing and customer service needs.

Use by Sozialens We use our own subscription service to create campaigns where users can learn more about Sozialens. The information we collect and manage through the Subscription Service for our own marketing purposes is the property of Sozialens and its use, disclosure and protection are governed by this Sozialens Privacy Policy.

Use by our customers Our customers use the Subscription Service to create campaigns to help users learn more about their businesses. When customers use the Subscription Service, they may collect personal information such as first and last name, email or mailing address, or phone number. Sozialens does not control the content or types of information our customers collect or manage through the Subscription Service. This information belongs to them and they may use, disclose and protect it as set forth in their respective privacy policies. Sozialens processes our customers' information as they provide it and in accordance with our agreements with them and stores it on our service providers' servers. Our agreements with our customers prohibit us from using such information except as necessary to provide and improve the Subscription Service within the limits set forth in this Product Privacy Policy and legal requirements.

We use information collected by our customers through our Subscription Service for the following purposes: to provide the Subscription Service (which may include detecting, preventing, and resolving security and technical issues); to respond to customer support requests; and to comply with obligations set forth in the Sozialens Customer Terms and Conditions of Service.

We do not have a direct relationship with individuals, “influencers,” who provide personal data to our customers. Our customers are responsible for and accountable for correcting, deleting, or updating the data they have collected through the Subscription Service. We may work with our customers to help notify their influencers about their collection, processing, and use of data.

2. How we share the information we collect

A. With service providers

We employ third party vendors to provide services on our behalf to users of our websites and customers and users of the Subscription Service, and we may need to share your data with them in order to provide you with information, products or services. Examples include: removing duplicate information from influencer lists, statistical or data analysis, marketing assistance, processing credit card payments, supplementing the information you provide to us in order to provide you with better services, and providing customer service or technical support. These service providers are prohibited from using your personal information for any other purpose and are required to protect the confidentiality of your data. In all cases where we share your information with such agents, we will explicitly require the agent to acknowledge and abide by our privacy policies and handling of customer data. Examples of such service providers can be found on this page.

B. Due to corporate events

If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company will receive all of the information that Sozialens has collected on the Websites and the Subscription Service. In such an event, you will be notified by email and/or a prominent notice on our website of any change in ownership, uses of your personal data, and any choices you may have regarding your personal data.

C. According to forced disclosure

We reserve the right to use or disclose your personal data if required to do so by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.

3. Sozialens Product-Specific Privacy Information

A. All plans and product levels

i. Third-Party Sites or Services

On our sites and services, you may find links to third-party sites and services. We are not responsible for the collection, use, monitoring, storage, or sharing of personal information by these third parties and we encourage you to review their privacy notices and ask them questions about their privacy practices as they relate to you.

ii. Google Integrations

If you choose to integrate your Gmail or any other G Suite application with the Subscription Service, you may use the following integrations and allow Sozialens to access your Google user data:

(1) Gmail Integration By using the Gmail Integration with the Subscription Service, you grant the Subscription Service access to information associated with your account, including contacts, emails, calendar, distribution lists, email subjects, and tracked link URLs in your email, if you use the email tracking functionality. In addition, the Subscription Service may read, modify, create, and send emails from your connected Gmail account. The Subscription Service will scan the content of your emails to identify the emails you have chosen to monitor in order to provide you with the notifications feature. The Subscription Service will store replies, outgoing mail, email headers, email subjects, distribution lists, aliases, send times, and message bodies. Your emails may contain sensitive information, such as contact names, private communications, or medical or financial information. You agree that the emails you monitor will be visible to other users on your subscription computer.

If you connect your Gmail account using IMAP (or generic inbox connection), the Subscription Service will have access only to the email address, password, server information, email metadata, and message text. Additionally, to connect your Gmail account using IMAP, you do not need to connect any other G Suite applications.

Additional Limits on Use of Your Google User Data: Notwithstanding anything else in this Product Privacy Policy, if you give Sozialens access to your Gmail data using the Gmail integration, our use of that data will be subject to these additional restrictions:

We will only use the access to read, write, modify, or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web-based email client that enables users to compose, send, read, and process emails, and to improve the email experience to boost productivity.

We will not transfer this Gmail data to others unless necessary to provide and improve these features, to comply with applicable law, or as part of a merger, acquisition, or asset sale.

Sozialens will not use this Gmail data for advertising purposes.

Sozialens will not allow others to read this data unless we have your opt-in for specific messages; This is necessary for security reasons, such as investigating a case of abuse, complying with applicable law, or for Sozialens internal operations where data has been aggregated and anonymized.

(2) Google Calendar Integration The Subscription Service will have access to Google Calendar and any other calendars you access through Google for the operation of the Media Plan tool and to allow you to associate events with IRM influencers. The Subscription Service will have the ability to create or change your calendars and update individual calendar events.

(3) Google Drive Integration As a result of the connection to Google Drive, the Subscription Service will be able to view your files, upload and download them, and store file content and titles. The Subscription Service uses these permissions to operate the features of our Documents and Content tools, allowing you to create draft briefs or social posts in Drive and then upload them directly for publication.

(4) Google Search Console You may integrate Google Search Console with our Content Management System (CMS). As part of this integration, the Subscription Service will be able to: manage the list of sites and domains that you control, view and manage the list of sites and domains that you control, view and manage the owners of the domains that you control.

(5) Chrome Extensions Email Extension: You can install the Email extension for Chrome to monitor Gmail and G Suite emails using your Chrome browser. The extension can Read and change your data on the websites you visit and display notifications. It logs all Gmail emails and can be used with the Inbox integration.

Documents Extension: The Documents extension integrates with Google Drive, allowing you to upload files and text directly from your Chrome browser to your Drive. These files will be available for you to use through the Google Drive integration.

Social Extension: The Social extension for Chrome allows you to view influencer information directly from the social network itself and add influencers to your IRM. You can assign influencers to campaigns and lists. The Social extension only accesses information about the current page, after clicking the toolbar button, using the permissions granted here: https://developer.chrome.com/extensions/activeTab#motivation

iii. Outlook Email Add-in

If you use the Outlook integration with the Sozialens Product, the Subscription Service will have access to information associated with your account, including contacts, emails, calendar, distribution lists, subject lines, and URLs of monitored links in your email, if you use the email monitoring functionality. The Sozialens Product will scan the content of your emails to identify the emails you have chosen to monitor in order to provide you with the notifications feature. The Subscription Service will store replies, outgoing mail, email headers, email subjects, distribution lists, aliases, send times, and message bodies. Correspondence you monitor will be visible to other users of your subscription.

iv. Generic Inbox Connection (IMAP)

If you connect your email account using IMAP (or generic inbox connection), the Subscription Service will have access only to the email address, password, server information, email metadata, and message bodies. Additionally, to connect your Outlook account using IMAP, you do not need to connect other Microsoft applications.

v. Voluntary Crowdsourced Data

If you use our Sozialens IRM software, you will see fields in the influencer database marked with pink or purple dots or otherwise highlighted. These fields are the ones we allow Sozialens IRM users to update in order to keep the influencer database as up-to-date as possible. Crowdsourced data fields only capture information about the influencer and are not intended to collect personally identifiable information. If you choose to include updated information in these fields, you authorize us to use such information in any way we choose (including publicly, without limitation) without compensation or credit to you. You represent and warrant that you have the right to share such information with us for our use and that you are not in breach of any confidentiality obligation by submitting the information. This information you submit will not be considered Customer Information or Confidential Information under this Agreement.

vi. Documents Tool

If you use the Documents feature of the Subscription Service, we store the files you upload using this feature and share them with other users on your Sozialens CRM team.

vii. Content

If you choose to use the shared content validation feature of our Content feature, you understand that the content of this feature may be accessed or viewed by any user on your team.

B. Social Media Integrations for Clients

i. YouTube Integration

If you use the YouTube integration, you agree to the YouTube terms, available at https://www.youtube.com/t/terms.

If you choose to connect your YouTube account to the Sozialens platform to manage your YouTube account:

i. a. When you post on YouTube using the Subscription Service, the Sozialens platform will store your posts and send them at the scheduled time you select. Subject to your product plan.

i. b. When you post on YouTube using the Subscription Service, the Sozialens platform will store your posts and publish them at the scheduled time you select. In addition, the Subscription Service will add a tracking code to any URL generated through the Sozialens platform, solely for the purpose of monitoring clicks. The Subscription Service stores comments and replies on your posts, as well as analytics for the performance of your posts. By using this functionality, you confirm and agree that we may share or make public this information at our sole discretion.

ii. Twitter Integration If you use the Twitter integration, you agree to the Twitter terms, available at https://twitter.com/en/tos

If you choose to connect your Twitter account to the Sozialens platform to manage your Twitter account:

ii. a. To send direct messages using the Subscription Service, the Sozialens platform will store your messages and send them at the scheduled time you select. Subject to your product plan.

ii. b. To tweet using the Subscription Service, the Sozialens platform will store your tweets and publish them at the scheduled time you select. In addition, the Subscription Service will add a tracking code to any tweet URL generated using the Sozialens platform, solely for the purpose of monitoring clicks. The Subscription Service will store your tweet responses and performance analytics. By using this functionality, you confirm and agree that we may share or make public this information at our sole discretion.

iii. LinkedIn Integration Your use of the LinkedIn integration is also subject to the terms and conditions provided by LinkedIn, available at https://www.linkedin.com/legal/sas-terms. If you choose to connect your LinkedIn account to the Sozialens platform to manage your account, we will store your account name and profile picture, and:

iii. a. To send messages on LinkedIn through the Subscription Service, the Sozialens platform will store your messages and publish them only at the scheduled time you have selected. Subject to your product plan.

iii. b. To post on LinkedIn through the Subscription Service, the Sozialens platform will store your content and publish it only at the scheduled time. In addition, the Subscription Service will add a tracking code to any URL generated through the Sozialens platform, solely for the purpose of monitoring clicks. The Subscription Service stores comments and replies on your posts, as well as analytics for the performance of your posts. By using this functionality, you confirm and agree that we may share or make public this information at our sole discretion.

v. Facebook and Instagram Integrations Your use of the Facebook and/or Instagram integration is also subject to the terms and conditions provided by Facebook, available at https://www.facebook.com/legal/terms, and by Instagram, available at: https://help.instagram.com/478745558852511

If you choose to connect your Facebook and/or Instagram account to the Sozialens platform to manage your Facebook or Instagram account:

v. a. To send messages on Facebook and Instagram through the Subscription Service, the Sozialens platform will store your content and send it only at the scheduled time you select. Subject to your product plan.

v. b. To post content on Facebook and Instagram through the Subscription Service, the Sozialens platform will store your content and post it only at the scheduled time. In addition, the Subscription Service will add a tracking code to any URL generated through the Sozialens platform, solely for the purpose of monitoring clicks. The Subscription Service stores comments and replies on your posts, as well as analytics for the performance of your posts. By using this functionality, you confirm and agree that we may share or make public this information at our sole discretion.

C. Other product specific information

i. Integrations with the Sozialens Platform You may choose to connect a variety of applications or integrations, including our certified partner applications, to your Sozialens account. Your use of these integrations is subject to the privacy terms provided by the integrator.

ii. Mobile Applications In our mobile application, we use mobile statistics software to better understand the functionality of our mobile applications on your device. This software allows us to record information such as how often you use the application, events that occur within the application, aggregate usage, performance data, and where the application was downloaded from. In addition to the information we collect on our Websites, when you use our Mobile Applications we may also collect data about the model and version of the device you are using, the device identification number (or “UDID”), operating system version, and your Sozialens Subscription Service credentials. From time to time, we send push notifications to keep you up to date about current events or promotions. If you wish to stop receiving these notifications, you can disable them from your device.

We may link the information we store in the analytics software with the personal information you submit from the mobile application. This allows us to improve the services we offer you, as well as our marketing strategy, statistics and site functionality.

iii. Single Sign-On You may log in to our site using a single sign-on (SSO) service, such as your Google account. This service will authenticate your identity and give you the option to share certain personal data with us, such as your name and email address, to pre-populate our registration form. Such services may give you the option to post information about your activities on this website on your profile page, and thus share it with others in your network.

iv. Log Files When you use the Subscription Service, we automatically collect information about your computer hardware and software. This information may include your IP address, browser type, domain names, Internet service provider, files viewed on our site (e.g. HTML pages, graphics, etc.), operating system, clickstream data, access time, and referring website addresses. Sozialens uses such information to operate the Subscription Service and to maintain the quality of this service. For these purposes, we link this automatically collected data with personal data such as name, email address, home address, and telephone number.

4. Interested party requests

If you are a customer or influencer or otherwise interact with one of our customers and no longer wish to be contacted by one of our customers using the Subscription Service, please contact the customer you interact with directly. If you wish to access, correct, amend or delete data controlled by an Sozialens customer, you should direct your inquiry to the Sozialens customer (the data controller). We will work with our customers to fulfill data-related requests as described in Section 5 of our Data Processing Agreement.

You may request deletion of your Sozialens account or the Subscription Service by emailing [email protected]. If you are seeking to exercise your rights to access data that Sozialens processes as a data processor, please refer to this Privacy Policy.

5. Data retention

This data that you collect as part of your use of the Subscription Service is retained in accordance with the relevant agreements between you and Sozialens. Customer data will be retained for as long as you remain an active customer. Your data is deleted upon written request or after a set period upon termination of all customer agreements. Customer data is generally deleted after the subscription ends and your account becomes inactive.

6. How the data we collect is transferred internationally

International transfers to third parties

Some of the third parties described in this Privacy Policy that provide services to us under the contract have offices in other countries that may not have data protection and privacy laws equivalent to the country in which you reside. However, Sozialens has implemented measures to ensure that such transfers do not result in a lower level of protection of your personal data.

In this regard, service providers outside the EEA have signed the corresponding standard contractual clauses approved by the European Commission ("STC"), an agreement signed between the two entities by which the non-EU company guarantees that it applies European data protection standards.

Therefore, the use of these providers does not result in a lower degree of protection of your personal data than the use of providers located in the European Union.
